Acceptable Use Policy

This Acceptable Use Policy (the “AUP”) governs your use of the MARC service provided by Mediacle Limited. It forms part of, and is incorporated into, the SaaS Terms and Conditions. Capitalised terms have the meanings given there. Breach of this AUP is a material breach of the SaaS Terms and Conditions.

1. General standards

1.1 You must use the Service only for lawful business purposes, in accordance with this AUP and all applicable laws and regulations, and only where you have all necessary rights and permissions.

1.2 You are responsible for all activity carried out under your account and by your Authorised Users.

2. Rights, permissions and third-party sites

2.1 You must only submit, scan, crawl, monitor or analyse websites, URLs, affiliate pages, content, data or materials where you have the legal right and any necessary permission to do so.

2.2 In particular, before directing the Service to access any third-party website or content you must ensure that doing so is lawful and permitted, including compliance with: the relevant website’s terms of use; applicable robots.txt and crawling directives; any contractual restrictions; intellectual property and database rights; and Data Protection Legislation. You are responsible for obtaining any required affiliate or third-party consents.

2.3 You must not use the Service to circumvent access controls, paywalls, authentication or technical protection measures on any third-party system.

3. Prohibited technical conduct

3.1 You must not use the Service to:

  • scrape, harvest, copy or extract data unlawfully or in breach of a third party’s rights or terms;
  • attack, overload, disrupt, degrade or impair any website, server, network or system, including by excessive request volumes, denial-of-service or distributed denial-of-service activity;
  • gain or attempt to gain unauthorised access to any system, account or data;
  • introduce or distribute any virus, malware or other harmful code;
  • reverse engineer, decompile, disassemble or otherwise attempt to derive the source code, models, algorithms or underlying structure of the Service, except to the extent this restriction cannot be excluded by law;
  • copy, resell, sublicense, rent, or make the Service available to any third party except as expressly permitted; or
  • use robots, scripts or automated means to access the Service other than through the interfaces we provide.

4. Prohibited purposes and content

4.1 You must not use the Service in connection with:

  • illegal gambling, unlicensed gambling, or gambling activity directed at jurisdictions where it is prohibited or restricted or where you are not licensed;
  • fraud, deception, money laundering, or the facilitation of any criminal offence;
  • unlawful surveillance, monitoring of individuals, unlawful profiling, or unlawful data extraction;
  • spam, unsolicited communications or other abusive messaging practices;
  • content that is unlawful, infringing, defamatory, obscene, or that facilitates harm; or
  • any activity that infringes the intellectual property, privacy or other rights of any person.

4.2 You must not use the Service in any way that could damage, disable, overburden or impair the Service or interfere with any other customer’s use.

5. Compliance-specific acknowledgements

5.1 The Service is an automated assistance tool. You must not represent the Output as legal advice, regulatory advice, an audit, a certification of compliance, or as a guarantee that any content is compliant or non-compliant.

5.2 You must apply your own competent human review and obtain independent legal and regulatory advice before acting on any Output. You remain solely responsible for your compliance obligations and decisions.

6. Security and account use

6.1 You must keep account credentials secure, not share them improperly, and manage your Authorised Users’ access appropriately. You must notify us promptly of any suspected security incident or unauthorised use at [email protected].

7. Monitoring and enforcement

7.1 We may (but are not obliged to) monitor use of the Service for security, operational and compliance purposes, and may investigate suspected breaches.

7.2 If we reasonably believe this AUP has been breached, or where required by law or a third-party provider, we may take action including issuing warnings, restricting or suspending access, removing content, and terminating the Service, in accordance with the SaaS Terms and Conditions. We may also report unlawful activity to the relevant authorities.

7.3 We are not liable for any loss arising from action taken in good faith under this AUP.

8. Changes

8.1 We may update this AUP from time to time. The current version is published on the Website. Continued use of the Service after changes take effect constitutes acceptance.
