1. What MARC is
1.1 MARC is an automated compliance-assistance and monitoring tool for the iGaming sector. It uses artificial intelligence, machine learning, large language models, automated crawlers, data extraction, rules, classifiers and scoring, together with third-party infrastructure and AI providers (currently Anthropic and OpenAI), to scan, read and analyse online content and turn observations into structured Output.
2. What MARC is not
2.1 The Service and the Output are not legal advice, regulatory advice, gambling-compliance advice, advertising or marketing compliance advice, AML or KYC advice, responsible-gambling advice, consumer-protection advice, an audit, a compliance certification, or any other form of professional advice.
2.2 Using the Service does not create any advisory, fiduciary, agency, legal-adviser, auditor, compliance-officer or regulator-facing relationship or duty between Mediacle and you or any third party. Mediacle does not act as your compliance function and does not accept any regulator-facing responsibility.
3. No guarantee of accuracy or completeness
3.1 We do not warrant or guarantee that:
- the Service will identify all compliance issues, risks or breaches;
- any Output is or will be complete, accurate, current, reliable or suitable for any particular licence, regulator, jurisdiction, product, promotion, market or business;
- the Output is free from false positives or false negatives.
3.2 The Service may: miss issues; flag matters that are not in fact issues; produce inaccurate, incomplete, outdated, false-positive or false-negative Output; and misunderstand website content, context, jurisdiction, licence scope, regulatory requirements or your specific obligations. Errors in AI processing, crawling, data extraction, classification, mapping, scoring, reporting and monitoring may occur and are expressly disclaimed.
3.3 AI and large-language-model technology is probabilistic and can generate outputs that are plausible but incorrect. Regulatory references and mappings within the Service are general and may not reflect the current law or the requirements of any particular regulator or licence.
4. Your responsibilities
4.1 You remain solely and exclusively responsible for your legal, regulatory, licensing, advertising, affiliate-marketing, AML, KYC, responsible-gambling and consumer-protection compliance, and for all decisions and actions you take.
4.2 Before relying on or acting on any Output, you must:
- obtain your own independent legal and regulatory advice; and
- carry out your own competent human review and verification.
4.3 The Output is provided for information and operational support only. It is a starting point for your own review, not a substitute for it.
5. Liability
5.1 Our liability in connection with the Service and the Output is limited and excluded as set out in the SaaS Terms and Conditions, including the exclusion of liability for regulatory fines, penalties, sanctions, investigations, enforcement action, licence issues, loss of profits, revenue, business or goodwill, and for reliance on, or missed, inaccurate or incomplete, Output. Nothing in this Disclaimer excludes liability that cannot be excluded under English law.
6. Acceptance
6.1 By using the Service or the Output, you acknowledge and accept this Disclaimer.
